Overtime is calculated based on a workweek – which is a 7-day period established by your employer. However, semi-monthly pay periods can be confusing when determining overtime pay, due to the way the pay period cuts across workweeks.. Since most months have more than just 4 weeks, or 28 days, a semi-monthly pay period will often include days in 3 separate workweeks. a, june 8, , 7 comp. gen. postal employees - extra pay for night work under the act of , 45 stat. , providing for payment to postal employees of extra pay for night work at the rate of 10 percent of their hourly pay per hour, the "hourly pay" of all postal employees affected by the act, except clerks in the railway mail service, should be computed in accordance.

Overtime pay for hourly employees is the additional pay rate paid for working more than a specific number of hours in a week. The federal minimum for overtime for hourly employees is that the person must be paid one and a half times the regular hourly rate for work over 40 hours a week. Exempt classification is on a case-by-case basis and. The Fair Labor Standards Act (FLSA) requires covered employers to pay nonexempt employees overtime pay for all hours worked over 40 in a workweek. A workweek consists of seven consecutive hour periods that equal total hours and can differ from the pay period. When an employee has multiple pay rates in a pay period, the calculation of overtime can become more difficult.

For work beyond normal working hours and upto 9 hrs. a day or beyond hrs upto 48 hrs in a week, overtime is paid under departmental rules which is known as DOT. For work done beyond 9 hrs. a day or 48 hrs a week, payment is admissible at twice the rate of pay plus all allowances under the Factories Act (often loosely termed as OT Bonus).   This basically means they are entitled to overtime pay if they work more than 40 hours a week. But in the last 15 years, the U.S. Department of Labor (DOL) recognized the need to reward more employees who render excessive hours. In Septem , DOL announced a new rule that would make million American workers eligible for overtime.

For covered, nonexempt employees, the Fair Labor Standards Act (FLSA) requires overtime pay (PDF) to be at least one and one-half times an employee's regular rate of pay after 40 hours of work in a workweek. Some exceptions apply under special circumstances to police and firefighters and to employees of hospitals and nursing homes.

Federal and state laws require most employers to pay overtime. The overtime premium is 50% of the employee's usual hourly wage. This means an employee who works overtime must be paid "time and a half"—the employee's usual hourly wage plus the 50% overtime premium—for every overtime.

That will be your basis when you are checking if the employee is a minimum wage earner or not. Which if you look in the DOLE website in NCR, that is above minimum wage earner so you should deduct taxes to the employee’s salary assuming that there is no other applicable tax exemption.

Legislative actions, practices, customs, Treaties, and Conventions have standardized working hours as eight (8) hours per day and five (5) days per week.
